§ 19771 Military Leave For Employees

Key Takeaways

  • •If you work for the government and get called to active military duty, you can take a leave from your job for up to 5 years.
  • •Your boss must let you go and keep your job open while you're serving.
  • •If there's a special agreement (like a union contract) that says something different, that agreement wins—but only if the government approves it in the budget.

Example

John works for the state as a park ranger. He gets orders to serve in the Army for 3 years.

John's boss must let him take a leave from his job for those 3 years. His job will be waiting for him when he comes back.
