§ 19774 Military Leave For Reserve Duty

Key Takeaways

  • •If you're in the military reserves or National Guard and have to do certain duties (not regular training), you can take time off work without pay.
  • •You can choose to use your vacation time or extra time you've earned at work instead of taking unpaid leave for these duties.
  • •If your work has a special agreement that says something different about this, that agreement wins—but only if the government approves it if it costs money.

Example

You're in the National Guard and get called to help with a flood for a week.

Your boss has to let you take that week off without paying you. But if you want, you can use your saved-up vacation days to still get paid.
