§ 11008 Unclaimed State Agency Payments

Key Takeaways

  • •If a state agency writes a check for a claim but the person doesn't cash it for 6 months, the money doesn't just sit there.
  • •The state agency has to send that unclaimed money to the Treasurer to hold onto.
  • •This rule doesn’t apply to the State Compensation Insurance Fund—only other state agencies.

Example

Imagine the state writes you a check for $500 because your car got damaged in a pothole, but you lose the check and forget about it for 7 months.

Since you didn’t cash the check within 6 months, the state agency can’t just keep that $500 in their account. They have to send it to the Treasurer to hold in trust until you remember and ask for it.
