§ 100 State Sovereignty And Process

Key Takeaways

  • •The power of the state comes from the people, not the government.
  • •All official papers and court actions must say they are done in the name of 'The People of the State of California'.
  • •When someone is taken to court for breaking the law, it’s like the people of California are bringing the case, not just the police or a judge.

Example

If someone steals a bike and gets arrested.

The court papers won’t say the police are taking them to court. Instead, it will say 'The People of the State of California' are taking them to court because the power comes from all the people, not just the police.
