§ 2056 Landowner Liability For Species Surveys

This law says that if a landowner's property has endangered or threatened animals, the owner can't be sued for civil damages if state workers get hurt while doing surveys or recovery work on those animals.

Key Takeaways

  • •Landowners with endangered or threatened species on their land are protected from civil lawsuits for injuries to state workers doing related work.
  • •The protection applies only to injuries that happen while the workers are conducting surveys, management, or recovery efforts for those species.
  • •The purpose is to encourage landowners to cooperate with conservation efforts.

Example

A farmer owns a field where a rare turtle lives. State biologists come onto the field to count the turtles and one slips and breaks an arm.

Even though the farmer didn't cause the injury, the law says the farmer can't be held financially responsible for the biologist's injury because it happened during the turtle survey.

§ 2056 Landowner Liability For Species Surveys

The Legislature further finds and declares that the cooperation of the owners of land which is identified as habitat for endangered species and threatened species is essential for the conservation of those species and that it is the policy of this state to foster and encourage that cooperation in furtherance of the purposes of this chapter. Therefore, a landowner of property on which an endangered, threatened, or candidate species lives shall not be liable for civil damages for injury to employees of, or persons under contract with, the department if the injury occurs while those persons are conducting survey, management, or recovery efforts with respect to those species. (Amended by Stats. 1987, Ch. 286, Sec. 1.)
