§ 14972 Board Member Terms

This law explains how long board members serve and how new members are chosen to fill empty spots.

Key Takeaways

  • •Board members normally serve 3‑year terms.
  • •The first board has a mix of 3‑year, 2‑year, and 1‑year terms to stagger expirations.
  • •Vacancies are filled only for the unfinished portion of the original term.

Example

A new city planning board is being created for the first time.

When the board is first set up, two members get a full three‑year term, two members get a two‑year term, and one member gets a one‑year term. After that, everyone serves full three‑year terms. If a seat becomes empty before the term ends, the replacement serves only the remaining time of that original term.

How to Calculate

Term length assignment for first board: 2 members × 3 years + 2 members × 2 years + 1 member × 1 year

  1. Identify the standard full term (3 years).
  2. Assign two members to serve the full 3‑year term.
  3. Assign two members to serve a shortened 2‑year term.
  4. Assign one member to serve a shortened 1‑year term.
  5. When a vacancy occurs, appoint a replacement to serve the rest of the original term.

A board member who was supposed to serve a 3‑year term resigns after 1 year.

Result: 2 years remaining on the original term, so the replacement serves 2 years.
