§ 14671 Department Injunction Authority

This law lets the department go to court to stop anyone from breaking the rules, and the court can order them to stop, even if they don't have to prove big harm.

Key Takeaways

  • •The department may sue in superior court to stop rule violations.
  • •The court can issue temporary or permanent orders (injunctions) to stop the bad behavior.
  • •The department doesn't have to prove serious or irreversible damage to get the order.
  • •The court can also order other actions needed to make the law work.

Example

A factory keeps dumping waste into a river even though the rules say it can't.

The department can file a lawsuit and ask the court to order the factory to stop dumping right away and maybe forever, without having to show that the river is already badly damaged.
