§ 14623 Tonnage Report Late Fees

This law says you have to send a tonnage report twice a year. If you miss the deadline you pay a $200 late fee, and if the report is more than 90 days late you can lose your license.

Key Takeaways

  • •You must send the tonnage report twice a year on the dates the rules set.
  • •Missing a deadline costs $200, no matter how many licenses you hold.
  • •If the report is more than 90 days late, the secretary can take away your license.

Example

A farmer has three fertilizing‑material licenses and forgets to send the reports on time.

Even though the farmer missed the deadline for three licenses, the law only lets the secretary charge one $200 late fee. Because the reports are only 45 days late, the farmer keeps the licenses.

How to Calculate

LateFee = $200 if any required report is submitted after the deadline; otherwise $0. (Only one $200 fee per person, no matter how many licenses.) Revocation = true if DaysPastDue > 90; otherwise false.

  1. Look at the due date for the semi‑annual report.
  2. See if the report was turned in on or before that date.
  3. If it was late, charge $200 (just one fee, even if the person has several licenses).
  4. Count how many days the report is past due.
  5. If the report is more than 90 days late, the license is revoked.

A rancher with two licenses turns in the report 20 days late.

Result: LateFee = $200 (only one fee despite two licenses). Revocation = false because 20 days < 90 days.

§ 14623 Tonnage Report Late Fees

The tonnage report shall be submitted to the secretary semiannually as specified by regulation. The secretary shall impose a late fee in the amount of two hundred dollars ($200) on any person who does not submit the report on or before the required dates. If a person has obtained multiple fertilizing materials licenses and the reports are submitted after the required dates, the late fee is limited to one two-hundred-dollar ($200) late fee per person. Any tonnage report that is more than 90 days past due is a cause for revocation of the license. (Amended by Stats. 2024, Ch. 208, Sec. 17. (SB 1522) Effective January 1, 2025.)
