§ 11764 Civil Action Not Barred

This law says you don’t have to mention in a lawsuit whether you filed a verified report, and even if you didn’t file one, you can still sue to get money for the loss or damage.

Key Takeaways

  • •You don’t need to allege filing (or not filing) a verified report in a complaint.
  • •Not filing a verified report does not stop you from suing for damages.
  • •You can still recover money for loss, nonperformance, or damage even without the report.

Example

A tenant’s ceiling leaks and damages their furniture, but they never filed a formal verified report with the landlord.

Even though the tenant didn’t file that report, they can still bring a civil case against the landlord to recover the cost of the damaged furniture.

§ 11764 Civil Action Not Barred

The filing of the verified report, or the failure to file it, need not be alleged in any complaint which may be filed. The failure to file the verified report of loss, nonperformance, or damage is not a bar to the maintenance of a civil action for the recovery of damages for the loss, nonperformance, or damage. (Amended by Stats. 1974, Ch. 774.)
