§ 11762 Growing Crop Damage Report

• •File a verified loss or damage report before 50% of the crop is harvested.
• •If you don’t discover the damage until after the crop is fully harvested, you can file the report later.
• •The rule applies only to damage caused by the activities listed in Section 11761.

A farmer’s wheat field is damaged by a nearby construction project. The farmer notices the damage when the wheat is only 30% grown and files a report right away.

Because the farmer reported the loss before half the wheat was harvested, the report follows the law’s rule. If the farmer had only noticed the damage after the wheat was fully harvested, the law would still allow a later report.
