§ 10421 Brucellosis Herd Slaughter Rules

This law lets the secretary order testing and, if needed, killing of animals that test negative for a disease when normal ways can't stop the disease, and the owner must be paid for the loss.

Key Takeaways

  • •The secretary can require testing and killing of non‑reacting animals if normal control methods won’t work.
  • •The secretary must decide that slaughter is the best way to stop the disease.
  • •A voluntary agreement with the animal owner and money to pay the owner are required.

Example

A farmer has a herd of cows. Some cows test positive for bovine brucellosis and the rest test negative. The secretary decides the disease can’t be controlled with regular methods, makes a deal with the farmer, and orders the negative cows to be killed and the barn cleaned, paying the farmer for the dead cows.

Because the secretary finds the disease can’t be stopped the usual way, agrees with the farmer, and has money to pay the farmer, the law allows the secretary to require the killing of the negative cows and disinfect the premises.

§ 10421 Brucellosis Herd Slaughter Rules

Notwithstanding any other provision of this chapter, the secretary may proceed with the identification of nonreacting animals in a herd in the same manner as provided in Section 10401 and require the slaughter of those animals and the disinfection of the premises where the animals have been kept if all of the following requirements are satisfied: (a) The secretary determines that bovine brucellosis cannot be eradicated or effectively controlled in the particular herd by the usual recognized methods. (b) The secretary determines that slaughter of the remaining exposed nonreacting animals in the herd is the best and most practical method of attaining eradication or control. (c) The secretary has entered into a voluntary agreement with the owner of the nonreacting animals to carry out the purposes and conditions of this chapter. (d) Funds are available to indemnify the owner of the nonreacting animals. (Amended by Stats. 1996, Ch. 653, Sec. 9. Effective January 1, 1997.)
