§ 10423 Brucellosis Indemnity Exclusions

This law says the government won’t pay money for a cow that’s sick with brucellosis or in several other specific situations.

Key Takeaways

  • •No payment if the cow shows brucellosis before or at the time it’s killed.
  • •No payment unless every animal on the farm (cattle, pigs, goats, sheep, horses) is also killed.
  • •No payment until the farm is cleaned and disinfected the way the state says it must be.
  • •Steers and grade bulls never qualify for payment.
  • •Animals owned by the government (state, county, city, or U.S.) don’t get payment.
  • •If the owner broke any rule in this chapter, they lose the payment.
  • •The animal must be killed within 30 days of being valued, or no payment.
  • •Animals that came from another state or country must have lived in the state at least 90 days before they qualify.

Example

A farmer’s cow tests positive for brucellosis, but the farmer does not clean the barn the way the state says he must before the cow is killed.

Because the barn wasn’t cleaned and disinfected the way the state requires, the farmer can’t get the payment that’s usually given for a dead cow.
