§ 16500 Court Contest Hearing Notice

This law says that after people file contest statements, the court clerk must tell the court within five days, and the judge must quickly set a hearing that will happen between 10 and 20 days after the order.

Key Takeaways

  • •The clerk must notify the court within 5 days after contest statements are filed.
  • •The judge must set the hearing time and place right away.
  • •The hearing must be scheduled at least 10 days and no more than 20 days after the order.

Example

Jane files a contest statement on March 1. By March 6, the clerk sends a notice to the court. The judge then picks a hearing date for March 15, which is 9 days after the order, so the judge would need to choose a date at least 10 days later, like March 16.

The clerk’s notice happens within five days, and the judge sets the hearing within the required 10‑20 day window.
