§ 16520 Affidavit Hearing Scheduling

This rule says the court clerk must hand all sworn statements to the judge within five days after the filing deadline, and the judge must quickly set a hearing date that is between 10 and 20 days after the order.

Key Takeaways

  • •The clerk has only five days after the filing deadline to give all affidavits to the judge.
  • •The judge must set the hearing right away.
  • •The hearing must be scheduled at least 10 days and no more than 20 days after the order.

Example

Jane files her sworn statements for a lawsuit on March 1. The clerk must give those statements to the judge by March 6. The judge then picks a hearing date, say March 15, which is 9 days after the order—so the judge would need to choose a date at least 10 days later, like March 16.

Because the clerk handed the statements to the judge within five days, the judge set the hearing date within the allowed 10‑20 day window, following the rule.
