§ 15341 Write-In Ballot Requirements

This law says a person's name on a ballot only counts if that person has followed the filing rules in Part 3 of Division 8.

Key Takeaways

  • •A name on a ballot isn’t automatically valid.
  • •The candidate must have completed the specific filing steps in Part 3 of Division 8.
  • •This rule applies to every election and overrides any other law that might say otherwise.

Example

Jane writes the name of her friend Sam on a voting ballot, but Sam never filed the required paperwork with the election office.

Because Sam didn't meet the filing requirements, the vote for Sam is ignored and doesn't count for any office.
