§ 45382 Employee Study Leave Eligibility

Key Takeaways

  • •You must work for the school district for 7 years in a row to get a leave for studying.
  • •You must work for the school district for 3 years in a row to get a leave for retraining.
  • •You can only get one of these leaves every 7 years (for studying) or every 3 years (for retraining).
  • •The time you take off for this leave doesn’t count as work time for getting another leave later.

Example

A teacher wants to take time off to go back to school and learn new teaching methods.

If the teacher has worked for the school district for 7 years straight, they can ask for time off to study. But if they take this time off, it won’t count toward the 7 years needed for their next study leave.

The governing board, or personnel commission in merit system districts, may prescribe standards of service which shall entitle the employee to the leave of absence. Any leave of absence granted under this article shall not be deemed a break in service for any purpose, except that such leave shall not be included as service in computing service for the granting of any subsequent leave under this article.
