§ 45114 Classified Employee Layoff Rules

Key Takeaways

  • •School boards can let go of workers (like janitors or bus drivers) if there's not enough money or work, but they have to follow special rules to do it.
  • •If different schools share the same board or office, they must treat all workers like they work for one big school when deciding who to let go.
  • •The school board has to follow the same rules as a 'personnel commission' (a group that usually handles worker problems) when hiring back workers they let go.

Example

A school district has less money and needs to let go of some bus drivers.

The school board can’t just pick who to fire—they must follow fair rules, like looking at who was hired last. If two schools share the same board, they must treat all bus drivers from both schools as one group when deciding who stays or goes.

Employees in common board or common administration districts shall, for the purpose of layoff for lack of work or funds, be considered as having been employed in a single district.
