§ 17411 District Lease Building Flexibility

Key Takeaways

  • •If a school district wants to lease more than one building, they can add a note on the ballot saying they might not lease all of them.
  • •If the note is on the ballot, the district can later decide not to lease some buildings without breaking any promises to voters.
  • •This rule helps the district be flexible if their plans change after the vote.

Example

A school district asks voters to approve leasing 3 new school buildings. They add a note on the ballot saying they might not lease all 3.

After the vote passes, the district realizes they only need 2 buildings. Because of the note on the ballot, they can choose not to lease the third building without any problems.

§ 17411 District Lease Building Flexibility

The governing board of the district, if the district proposes at an election held pursuant to Section 17409 to lease more than one building, may include in the ballot measure used in the election a statement that the district reserves the right to lease less than all of the proposed buildings designated in the ballot measure. If such a statement is included in the ballot measure, the governing board may at any time thereafter determine to not lease one or more of the buildings included in the ballot measure, and such determination shall not breach any obligation of the district to the voters of the district. (Added by Stats. 1996, Ch. 277, Sec. 3. Effective January 1, 1997. Operative January 1, 1998.)
