§ 17223 School Site Payment Refund

Key Takeaways

  • •If a school district starts using an empty site or sells it within 2 years, the state will stop taking money from them and give back what was already taken for that site.
  • •If the school district starts using or sells the site after 2 years, the state will stop taking money but won’t give back what was already taken.
  • •The state only gives back money taken in the last year and the current year, not older payments.

Example

A school district has an empty lot they aren’t using. The state starts taking money from them because of it. After 1 year, the district builds a playground on the lot.

Since the district used the empty lot within 2 years, the state will stop taking money and give back what was taken in the last year and the current year.
