§ 21308 Injunction Against Insignia Misuse

This law lets a court order someone not to wear a group's badge or use its name for business or fundraising unless the group’s rules or a written permission say they can.

Key Takeaways

  • •Courts can stop anyone from wearing or using an association’s insignia if they aren’t authorized.
  • •Courts can also stop the use of an association’s name in any business, advertising, or donation request without permission.
  • •Permission can come from the association’s constitution, by‑laws, rules, or a written consent.

Example

A person prints a sports club’s logo on hats and sells them online without the club’s approval.

Because the person isn’t allowed by the club’s rules or a written consent, a court can issue an injunction stopping the sales and the use of the logo.
