§ 8836 Owner Lender Stop Work Notice

Key Takeaways

  • •If a contractor sends a 'stop work' notice to the owner of a construction project, the owner must share this notice with the bank or lender funding the project.
  • •The owner has only 5 days to pass along the notice after receiving it.
  • •The notice must be shared in the same way as other important construction documents, following the rules in Chapter 2 of Title 1.

Example

A contractor working on a new house finds a big problem, like unsafe wiring, and sends a 'stop work' notice to the homeowner.

The homeowner must tell the bank that gave them the loan for the house about this notice within 5 days. They can't just ignore it or wait too long. They have to follow the same rules as sending other important papers, like using mail or email as required by law.
