§ 8832 Contractor Stop Work Notice

Key Takeaways

  • •If a contractor isn't paid on time (within 35 days after the due date) and they did their job well, they can stop working.
  • •The contractor must give the owner a special notice before stopping work.
  • •This rule only applies if there's a written contract and no argument about the contractor's work.

Example

A contractor builds a new kitchen for a homeowner. The contract says the homeowner will pay $10,000 within 30 days of the kitchen being finished. The kitchen is done perfectly, but the homeowner doesn't pay even after 35 days.

The contractor can send a special notice to the homeowner saying they will stop working until they get paid. This is allowed because the contractor did their job well and wasn't paid on time.
