§ 8530 Lienholder Stop Payment Notice

Key Takeaways

  • •If someone is owed money for work done on a building or property, they can tell the bank lending money for the construction to stop paying the owner until they get paid.
  • •This is only for people who have a legal right to get paid for their work on the property.
  • •The notice is given to the construction lender, not the property owner.

Example

A plumber fixes the pipes in a new house being built but doesn't get paid by the builder.

The plumber can send a notice to the bank that lent money for building the house. The notice tells the bank to stop giving money to the builder until the plumber gets paid for the work.
