§ 5661 Licensee Accusation Time Limits

Key Takeaways

  • •If someone with a license (like a doctor or builder) does something wrong, the complaint must be filed within 3 years of the board finding out about it.
  • •If the board should have found out about the wrongdoing by being careful, the complaint still must be filed within 3 years of when they should have known.
  • •For some serious wrongdoings like fraud, the complaint can be filed within 3 years of the board discovering the fraud.
  • •If the complaint is not filed on time, no action can be taken against the license holder.

Example

A doctor makes a big mistake during surgery that hurts a patient.

The patient or the medical board has to complain within 3 years of the board finding out about the mistake. If they wait too long, the doctor can't be punished for it.

All accusations against a licensee shall be filed within three years after the board discovers, or through the use of reasonable diligence should have discovered, the act or omission alleged as the ground for disciplinary action or within six years after the act or omission alleged as the ground for disciplinary action, whichever occurs first. However, with respect to an accusation alleging a violation of Section 5667, the accusation may be filed within three years after the discovery by the board of the alleged facts constituting the fraud or misrepresentation prohibited by Section 5667. If any accusation is not filed within the time provided in this section, no action against a licensee shall be commenced under this article. (Amended by Stats. 1989, Ch. 229, Sec. 2.)
