§ 3137 Licensee Discipline Time Limits

Key Takeaways

  • •If someone with a license (like a doctor or builder) does something wrong, the government has 3 years to find out and start a case against them, or 7 years from when the bad thing happened—whichever comes first.
  • •If the person lied on purpose or did something really bad (like fraud), there’s no time limit—they can be in trouble no matter how long ago it was.
  • •If a kid under 18 was hurt by the license holder, the government has up to 10 years to take action, but they only start counting time once the kid turns 18.
  • •If the police are still investigating a crime related to the case, the time limit pauses until the police finish their work.

Example

A doctor makes a big mistake during surgery and hurts a patient. The patient doesn’t realize it until 5 years later when they get really sick.

The government has 3 years from when they find out about the mistake to take action against the doctor. But if the mistake happened 8 years ago, they can’t do anything because 7 years have already passed.
