§ 18966 County Children’S Trust Fund

Key Takeaways

  • •Counties can create a special fund called a 'children’s trust fund' to help prevent child abuse and neglect.
  • •The money for this fund comes from birth certificate fees, gifts, grants, and other funds given by the government or private sources.
  • •Up to 10% of the birth certificate fee can be kept by the local office to cover the cost of collecting the money.
  • •If a mom lives in one county but gives birth in another, the $4 fee from her baby’s birth certificate goes to her home county’s trust fund (if they have one).

Example

A mom from Los Angeles gives birth in Orange County. She pays a $4 fee for the birth certificate.

Even though the baby was born in Orange County, the $4 fee goes to Los Angeles’ children’s trust fund because that’s where the mom lives. This helps pay for programs in Los Angeles that protect kids from abuse.

§ 18966 County Children’S Trust Fund

(a) When a county board of supervisors designates a commission pursuant to Section 18965, the board of supervisors shall establish a county children’s trust fund. The children’s trust fund shall consist of the fees for birth certificates, collected pursuant to Section 103625 of the Health and Safety Code, grants, gifts, or bequests from private sources to be used for child abuse and neglect prevention and intervention programs, any funds appropriated by local governmental entities to the trust fund, and any funds appropriated to the county for the trust fund by the Legislature. The local registrar or county recorder may, however, retain a percentage, not to exceed 10 percent, of the surcharge collectible pursuant to subdivision (b) of Section 103625 of the Health and Safety Code, in order to defray the costs of collection. (b) (1) The county treasurer shall transmit moneys collected from birth certificate fees for the county children’s trust fund, pursuant to subdivision (b) of Section 103625 of the Health and Safety Code, collected with respect to the birth certificate of a child whose mother was a resident of another county at the time of the birth to the treasurer of the county of the mother’s residence at the time of the birth if the county to receive the funds has established a program pursuant to this article. (2) Paragraph (1) applies only to the collection and payment of the four-dollar ($4) fee to the county children’s trust fund, pursuant to subdivision (b) of Section 103625 of the Health and Safety Code, and does not apply to the collection and payment of the two-dollar ($2) fee to the Umbilical Cord Blood Collection Program Fund or any other assessment authorized by statute and levied by a local jurisdiction. (Amended by Stats. 2014, Ch. 61, Sec. 1. (AB 2187) Effective January 1, 2015.)
