§ 1742 Youth Authority Exceptional Needs Transfer

Key Takeaways

  • •If a kid with special needs is sent to a youth facility, the court must make sure their special education plan goes with them.
  • •The court can't send the kid to the facility until their education plan is ready and given to the people in charge.
  • •The court must make sure the probation officer talks to the kid's school or special education team to get the plan.

Example

A 15-year-old with autism gets in trouble and is sent to a youth facility.

The court must wait until the kid's special education plan (like extra help with learning or therapy) is sent to the facility before the kid can go there. The probation officer has to talk to the kid's school to get this plan.
