§ 2852 Cost Allocation For Excess Expenses

Key Takeaways

  • •If the costs are more than the money collected from people involved, the extra cost gets split fairly among them.
  • •A board decides how to split the extra cost so everyone pays their fair share.
  • •This happens when the money from claimants isn't enough to cover all the expenses.

Example

A group of neighbors hire a lawyer to fix a shared fence. The lawyer's bill is $5,000, but they only collected $3,000 from the neighbors.

The extra $2,000 will be split fairly among all the neighbors by a board. So, if there are 10 neighbors, each might have to pay an extra $200.
