§ 2526 Water Rights Claim Notice

Key Takeaways

  • •If the board approves a water rights request, they must send out a notice to everyone who might use the same water source.
  • •Everyone who uses the water has 60 days (or more if the board allows) to tell the board they want to prove their right to use the water.
  • •People must give the board their address so they can get future notices about the water rights process.
  • •Later, everyone who claims water rights will have to prove their claim at a time set by the board.

Example

A farmer gets a notice saying someone else wants rights to the river water they use for their crops.

The farmer has 60 days to tell the board they also use that water and want to prove their right to keep using it. If they don’t respond, they might lose their chance to use the water later.
