§ 250 State Water Property Acquisition

Key Takeaways

  • •The state can take private land if they need it for water or dam projects.
  • •They can only do this if the project is approved and they have the money to pay for the land.
  • •This is called 'eminent domain'—it means the government can buy your land even if you don’t want to sell, but they have to pay you fairly.

Example

Imagine the state wants to build a new dam to store water, but there’s a farm in the way.

If the dam project is approved and the state has the money, they can force the farm owner to sell the land—even if the owner doesn’t want to. But the state must pay the owner a fair price for the farm.
