§ 22122 Power Generation Water Limits

Key Takeaways

  • •If a place uses extra water to make electricity, they have to follow the rules of who got the water rights first.
  • •Cities that are already working on projects to use water get priority over extra water used for power.
  • •The rule only applies if the city is actually spending money and building things to use the water.

Example

A town uses river water to grow crops. In summer, they have extra water and start using it to make electricity. But a nearby city is already building a dam to use that same water for its people.

The city gets to use the water first because they were already working on their project. The town can’t just take the extra water for electricity if the city needs it.
