§ 11131 State Land Use Agreements

This law says that if the state needs to use land or paths that are already being used by the public for a project, they have to make a deal with the department in charge of that land first.

Key Takeaways

  • •The state can use public land for projects, but only if they make a deal first.
  • •The deal has to be between the Department of Water Resources and the department that manages the land.
  • •This rule applies to land that was dedicated to public use in the past or will be in the future.

Example

The state wants to build a new water pipeline.

If the pipeline needs to go through a state park, the Department of Water Resources has to talk to the department that manages the park and agree on how to use that land before they can start building.
