§ 23216 Dui Offense Cross-Reference Rules

This law says that old drunk driving rules still count as the same crime even if the law number changed. It also makes sure past drunk driving offenses are treated the same way as new ones.

Key Takeaways

  • •Old drunk driving laws are treated the same as new ones, even if the numbers changed.
  • •If you got a DUI before 1982, it still counts as a prior offense today.
  • •This law works backward in time, meaning it applies to past cases too.

Example

A person got a DUI in 1980 under an old law number. Now, they get another DUI under a new law number.

The court will treat both DUIs as the same crime, even though the law numbers changed. The old DUI still counts against them.
