§ 23154 Dui Probation Alcohol Limit

This law says if you're on probation for drunk driving, you can't drive with any alcohol in your system. Even a tiny bit can get you in trouble.

Key Takeaways

  • •If you're on probation for drunk driving, don't drink any alcohol before driving.
  • •Even a little alcohol can get you in trouble if you're on probation.
  • •If a cop asks you to take a breathalyzer test, you have to do it or you could lose your license.

Example

John is on probation for drunk driving. He has one beer and drives home.

John can get arrested because he drank alcohol and drove, even if he doesn't feel drunk.

How to Calculate

Blood-alcohol concentration (BAC) ≥ 0.01%

  1. Check if the person is on probation for drunk driving (Sections 23152 or 23153).
  2. Test the person's BAC using a breathalyzer or other chemical test.
  3. If BAC is 0.01% or higher, the person is breaking the law.

Sarah is on probation for drunk driving. She has a small glass of wine and drives.

Result: Sarah is breaking the law because her BAC is above 0.01%.
