§ 7659 Railroad Crossing Obstruction Immunity

Key Takeaways

  • •Train drivers or conductors won't get in trouble if their train blocks a road crossing.
  • •This only applies if they can't move the train safely or if they can't control what's causing the block.
  • •Local rules can't punish them if these conditions are met.

Example

A train stops on the tracks and blocks a road crossing because there's a car stuck on the tracks ahead.

The train driver won't get in trouble for blocking the road because moving the train could hurt the people in the car or the train passengers.
