§ 5433 Rideshare Insurance Requirements

Key Takeaways

  • •If a driver is using an app like Uber or Lyft and has accepted a ride, the insurance must cover up to $1,000,000 for injuries, death, or property damage.
  • •If a passenger is in the car, the insurance must also cover up to $1,000,000 for uninsured or underinsured motorists.
  • •If the driver is logged into the app but hasn’t accepted a ride yet, the insurance must cover at least $50,000 for injury or death per person, $100,000 per accident, and $30,000 for property damage.
  • •The app company (like Uber or Lyft) must make sure the driver’s insurance is valid and covers rideshare driving.

Example

A driver is using the Uber app and gets into a car crash while driving a passenger to their destination.

The insurance must cover up to $1,000,000 for any injuries, deaths, or property damage from the crash. If the other driver doesn’t have insurance, the Uber driver’s insurance must still cover up to $1,000,000 for the passenger’s injuries.
