§ 29750 District Dissolution Election Rules

Key Takeaways

  • •If a transit district doesn't get money from voters for new trains or buses within 5 years, the leaders can ask voters if they want to shut down the district.
  • •If at least 25% of the voters who voted in the last big election sign a paper asking to shut down the district, the leaders must ask all voters if they want to shut it down.
  • •The leaders have to do what the voters say in this special vote.

Example

Imagine a city creates a new bus system but doesn't get money from voters to build it within 5 years.

If enough people (25% of those who voted in the last big election) sign a paper saying they want to shut down the bus system, the city leaders must hold a vote. Then, all voters decide if the bus system should be closed.

If district bonds for the acquisition or construction of rapid transit facilities have not been voted by the electors within five years of the creation of the district, the board of directors may call an election for the purpose of submitting to the voters of the district the question of whether the district will be dissolved. Upon the filing with the secretary of the district of a petition signed by voters within the district equal in number to at least 25 percent of the total vote cast in the district for all candidates for Governor at the last preceding general election at which a Governor was elected, asking that the question of dissolution of the district be submitted to the voters of the district, the board shall call an election for that purpose. (Amended by Stats. 1981, Ch. 714, Sec. 393.)
