§ 28833 General Manager Removal Process

Key Takeaways

  • •The general manager can stay in the job for as long as they want unless the board votes to remove them.
  • •The board needs more than half of its members to agree to fire the general manager.
  • •Before getting fired, the general manager can ask for a written reason and a public meeting to explain their side.
  • •The board can suspend the general manager while they figure things out.
  • •The board can't lower the general manager's pay unless they follow the same rules as firing them.

Example

Imagine the general manager of a city's water department is accused of not doing their job well.

The board can't just fire them right away. They have to vote, and more than half must agree. The manager can ask for a written reason and a public meeting to defend themselves. If the board still votes to fire them, that's the final decision.

§ 28833 General Manager Removal Process

The general manager shall hold office for an indefinite term and may be removed by the board only upon the adoption of a resolution by the affirmative vote of not less than a majority of the board. Before the general manager may be removed, he shall, if he demands it, be given a written statement of the reasons alleged for his removal and he shall have the right to be publicly heard thereon at a meeting of the board prior to the final vote on the resolution providing for his removal, but pending and during such hearing the board may suspend him from office. The board may not reduce the salary of the general manager below the amount fixed at the time of his original appointment except upon the adoption of a resolution by a like vote and after a like opportunity to be heard. The action of the board in suspending or removing the general manager or reducing his salary, if approved by a majority of the membership of the board, is final. (Added by Stats. 1957, Ch. 1056.)
