§ 27403 Transit District Formation Petition

Key Takeaways

  • •People can ask for a new special transit service area by signing a petition instead of waiting for officials to decide.
  • •At least 10% of the voters in the area must sign the petition.
  • •The petition must describe the area’s borders and include at least two public agencies or parts of them.
  • •If the whole area of a public agency is included, just naming the agency is enough to describe it.

Example

A group of people in a town want better bus service but the local government isn’t doing anything about it.

They can collect signatures from at least 10% of the voters in their area and write a petition describing where they want the new bus service to cover. If they include the whole town and the nearby school district in their plan, they can just name those places in the petition.

§ 27403 Transit District Formation Petition

As an alternative to the instigation of the formation of a special transit service district by resolutions, a petition may be filed with the secretary of a district signed by voters within the proposed special transit service district equal in number to at least 10 percent of the total vote cast. The boundaries of the proposed special transit service district shall be described in the petition and shall include at least two public agencies or portions thereof. A statement of the name of any public agency constitutes a sufficient and legal description of the territory if the entire area of the agency is included. (Added by Stats. 1959, Ch. 116.)
