§ 24865 Board Vacancy Filling Rules

Key Takeaways

  • •If someone leaves the board (like quits or dies), the board itself picks a new person to fill the spot.
  • •If the board doesn’t fill the empty spot in 90 days, the Governor steps in and picks someone instead.
  • •This rule is stronger than another old rule (Section 1780) that might say something different.

Example

Imagine a school board has 5 members, but one member moves away and quits.

The remaining 4 board members have 90 days to choose a new member. If they can’t decide and take too long, the Governor will pick the new member for them.
