§ 13487 Public Agency Inclusion Consent

Key Takeaways

  • •A special district can't include a public agency unless the agency agrees to it.
  • •The agency must say 'yes' by passing a resolution.
  • •If voters start the process to create the special district, the agency doesn't need to agree.

Example

A group of people want to create a special district to improve local parks. This new district would include a public school.

The school must agree to be part of the new district by passing a resolution. If the voters started the process to create the district, the school doesn't need to agree.
