§ 10107 Commission And Transportation Authority

This law says the Public Utilities Commission and the Department of Transportation keep all their power over state highways, and if there’s a clash, their power wins.

Key Takeaways

  • •The Public Utilities Commission and the Department of Transportation keep all their legal powers over state highways.
  • •No other law can take away those powers.
  • •If two agencies disagree, the commission or the transportation department’s authority wins.

Example

A city tries to tell a power company to move its power lines off a state highway, but the power company says the Public Utilities Commission already gave permission.

Because the law says the Public Utilities Commission’s authority can’t be limited, the commission’s decision beats the city’s request.
