§ 230 Survival Determination Petition

This law lets you ask a court to decide if a person is still alive when other laws need that information.

Key Takeaways

  • •You can file a petition to find out if someone survived for many different statutes.
  • •The petition can be used for benefits, money, or legal rights that depend on survivorship.
  • •The law lists specific sections (like 103, 220, 24611, etc.) where a survivorship decision is needed.

Example

A child wants to know if their mother is still alive so they can claim a survivor benefit from the Education Code.

The child can file a petition under this law to get a court ruling on whether the mother survived, which then lets the Education Code give the benefit.
