§ 612 National Guard Colors Standards

This law tells how the flags and colors for state National Guard and Naval Militia units must look, and it lets the Adjutant General give funeral flags to the families of deceased members so they become family property.

Key Takeaways

  • •Guard and Naval Militia units must use colors that match the federal Army, Air Force, or Navy standards, but they can add the state coat of arms.
  • •The Adjutant General can give the funeral flag to the family of a deceased Guard or State Guard member.
  • •Once given, the flag becomes the property of that family.

Example

A National Guard soldier dies in a car accident, and the Adjutant General presents the same ceremonial flag used by the Army to the soldier's family, which then becomes a keepsake for them.

Because the law allows the Adjutant General to deliver the service flag to the family of a fallen Guard member, the family receives that flag and can keep it.

(a) The colors and standards carried by organizations of the National Guard or Naval Militia shall be those which are carried by similar organizations of the United States Army, Air Force, or Navy, except that the regimental or battalion colors or standards may show the state coat of arms, instead of the coat of arms of the United States. (b) The Adjutant General may, pursuant to rules and regulations adopted for the purpose, deliver to the members of the family of a deceased member of the National Guard or of the State Guard the colors used during the disposition of the remains of the deceased member according to the custom and usual practice of the United States Army, Air Force, or Navy, which then become the property of the members of the family. (Amended by Stats. 2020, Ch. 97, Sec. 34. (AB 2193) Effective January 1, 2021.)
