§ 708 Foreign Insurer Admission Requirements

This law says a foreign insurance company must give the state certain papers before it can start selling insurance here.

Key Takeaways

  • •The insurer must file paperwork before it can be admitted to do business.
  • •If the insurer’s home state files articles of incorporation, a certified copy of those articles is required.
  • •If the home state doesn’t file articles, a certified copy of the law, charter, or deed that created the insurer (or an affidavit) is needed.
  • •A certificate proving the insurer meets the required capital or asset amount must also be filed.

Example

A car‑insurance company from Canada wants to sell policies to drivers in the state.

Before it can do business, the company has to send the state a copy of its articles of incorporation (or the law that created it), and a certificate showing it meets the required capital or asset levels.
