§ 8605 Cemetery Plot Transfer Authorization

Key Takeaways

  • •If someone who owns a cemetery plot dies, a simple written statement (affidavit) can prove who gets to use the empty parts of that plot.
  • •The statement must be from someone who knows the facts about the death and who is supposed to get the plot.
  • •The cemetery must accept this statement and let the right person use the empty parts of the plot.

Example

Grandma owned a family cemetery plot. When she passed away, her daughter wrote a statement saying she is the one who should get to use the empty spaces in the plot.

The cemetery must accept this statement and let the daughter use the empty parts of the plot for family burials.
