§ 79680 Hazardous Waste Cost Recovery

• •If the state spent money cleaning up dangerous stuff (like chemicals) before July 1, 2006, they can still make the person who caused the mess pay them back.
• •This rule applies even if the money came from special state accounts for handling hazardous waste.
• •The state can ask for the money back just like they could if the money came from the main state account.

A factory dumps chemicals into the ground and makes the area unsafe. The state cleans it up in 2005 and spends money from a special account for hazardous waste.

Even though the money came from a special account, the state can still make the factory owner pay them back for the cleanup costs.
