§ 34323 Housing Project Default Rights

Key Takeaways

  • •If the housing authority fails to do what it promised, the person or group who lent money (the obligee) can take over the housing project.
  • •The obligee can ask a court to put someone else in charge of the project (a receiver) if things go wrong.
  • •The obligee can also take full ownership of the project through a legal process called foreclosure, without following the usual rules that normally apply.

Example

A bank loans money to a city to build affordable apartments. The city stops making payments on the loan and doesn’t maintain the apartments like it promised.

The bank can step in, take control of the apartments, or even become the new owner through foreclosure, without worrying about the usual rules that protect housing projects.
