§ 13963 Multi-District Employee Relations

Key Takeaways

  • •If multiple school districts are run by the same board, they can use the same rules for employees in all districts.
  • •The board can create one test for jobs, one list of qualified people, and let workers move between districts easily.
  • •If workers are laid off because there’s not enough work, they get hired back first before new people.
  • •The board can decide how long the layoff list stays active.

Example

A teacher works in one school district but wants to move to another nearby district run by the same board.

The board can let the teacher transfer easily because they use the same hiring rules and tests for all districts. If the teacher gets laid off later, they’ll get their job back before new teachers are hired.

When more than one district is governed by the same board of directors, the district board may do all of the following: (a)  Adopt the same set of employee relations rules, regulations, and procedures for any or all districts. (b)  Authorize one examination for any or all districts for each classification of employment, establish one eligibility list, permit qualified candidates to transfer from one district to another, and allow requested changes in assignment. (c)  Adopt one seniority list to be used in the layoff of all employees of any or all districts. Persons laid off due to lack of work shall be eligible for reemployment and shall be reemployed in preference to the employment of new applicants. The district board may set a time limit on the use of this seniority list. (Added by Stats. 1987, Ch. 1013, Sec. 11.)
