§ 1238 County Prosecution Of Violations

Key Takeaways

  • •The district attorney (DA) in each county must help the state when asked.
  • •If someone breaks a rule in this law, the DA has to start the case against them.
  • •The DA only handles cases in their own county.

Example

A factory in a county dumps bad chemicals into a river, breaking state rules.

The state asks the DA in that county to take the factory to court. The DA must do it because it’s their job under this law.
